General terms of sale

Article 1: Prelude

The present conditions are concluded between, on the one hand, the public limited company of Belgian rights Garage Laeremans registered at the “Banque Carrefour des Entrepreneurs de Belgique” (number 0424599286); address: 204, rue de Hollogne, 4460 Jemeppe-sur-Meuse, hereinafter referred to as under commercial sign “Jet Spirit” and, on the other hand, the persons who want to buy via the internet site of Garage Laeremans SA Garage Laeremans http://www.jetspirit.be hereinafter referred to as the “user”.

Generalities

The parties agree that their relations are exclusively governed by the present contract, to the exclusion of every condition first available on the site.

If one condition failed, it would be considered to be governed by the uses in effect in the sales sector at distance which societies have got an office in Belgium.

The no application of one or more of these present dispositions can never be considered by the customer, buyer as a renunciation of these conditions.

The present conditions aim at defining the sales modes between Garage Laeremans SA and the user (for order, services, payment and delivery).

They settle every step necessary to be able to order and follow this order between the two parties.

Every site user who hasn’t got a customer’s number, will have to follow a registration procedure. That allows him to have, later on, his customer’s number.

Anyway, the final validation of the order involves the acceptance of this one, in full and at posted price, by the user.

That validation means signing and express acceptance of every transaction on the site.

Article 2: Terminology

The services proposed by Jet Spirit on its internet site, namely the products sales, will be hereinafter referred to as the “services Jetspirit”. Each person who wants to benefit from the services of Jetspirit and who has satisfied to the general sales conditions will be hereinafter referred to as a “customer”. Each firm which has commissioned “Jet Spirit” to sell a product that belongs to him on his site will be called a “supplier”. Each order made by a customer in the provided conditions will be called the “order”.

Article 3: Recording of personal data

Every physical or moral person, who records himself on the internet site www.jetspirit.be as a contracting potential party of Jet Spirit, communicates, through his recording, his personal data to Jet Spirit.

The recording involves the explicit consent that his data can be treated in the data file of Jet Spirit. Only the moral or physical persons who own the full ability of right and act may record themselves.

When you record yourself, the physical or moral person gets a number which identifies him and chooses a keyword which is confirmed by Jet Spirit and these data are confirmed by the sending of a recapitulative e-mail by Jet Spirit to the customer.

The customer is responsible of the data privacy, the security and the use concerning his identifier and his keyword.

Every use of the user identification and of the keyword of a certain customer is supposed to have been done by this customer.

Jet Spirit should be able to make impossible the user identification use and keyword on a temporary or permanent manner, if it becomes evident that the customer fails to take account of one or several conditions of the present general conditions.

The responsible of the personal data treatment of the customer is “Jet Spirit” info@jetspirit.be.

The treatment of these personal data in the file of Jet Spirit takes place with a view to the customer’s administration, the orders, deliveries, invoicing management, followed by the solvency, publicity by means of the profile, the personalized treatment and the marketing.

Article 4: Private life protection

Principles concerning the data collection (personal data).

In theory we can have the data on or via the site without giving personal data as name, address, electronics address…

Exceptionally, to get more service (request for data, member’s space, subscription for an information letter …) it is possible that some personal data, mostly address, phone number, should be asked the user. In that case, the user is informed and the data are treated as it is asked in the article 2002/58/CE.

In concrete terms, it means that: your personal data can be collected or treated only in the special context of their collection. At any time you can access these data and correct them, you have right of opposition, so you can verify if they are right and you can correct the possible errors. In that case you send us an e-mail to info@jetspirit.be, don’t forget to give us right address and phone number.

Use in order to make data statistics concerning the net surfing.

When you have access to the site, the consulted servers automatically collect the following data:
  • IP address you have received when you connected;
  • date and hour when you had access to the site;
  • consulted pages;
  • used browser;
  • platform and/or operating system installed on the computer
  • search engine and used keywords to find the site again.

These data are only kept to know how many visitors consult the site in its different sections and to upgrade the site.

Cookies use: to make easier your browser on the site and to make still better the technical management, Jet Spirit can sometimes use “cookies”. A “cookie” is a small information piece saved by a web site into the internet browser of your computer. The “cookie” can be retrieved during a later visit on this same site. The “cookie” can’t be read by another web site than the one who has created it. The site uses the “cookies” for administrative purposes to, for example, record your preferences for certain information types, that will avoid you to have to repeat the same imputs on the keypad when you visit our site.

Most of the cookies work only the time of a session or visit. None of them contains data that should permit someone to contact you by phone, e-mail or by letter. You can also configure your browser to inform you during the creating of “cookies” or to prevent their recording.

Article 5: Methods.

Every data connected with products as delivery costs and guarantee so that the prices are noticed on the descriptive file corresponding to each product.

The selling price of each product presented on the site of Jet Spirit is in Euros. This price includes the VAT (when it is applicable). On certain products, the taxes (Recupel or other) are included.
It can happen that the tax Recupel is asked at the moment of the payment. This will be underlined at the total payment.

The possible costs, delivery costs (see Art.6 conditions of sale) and additional guarantee aren’t included in the base price.

The sales without VAT to persons not subjected to VAT are only possible when the vouchers are given before.

The price that the buyer pays, called total price, is also explicitly indicated as “total price” at the moment of the order. If you have any question about the price modes you can send an e-mail to info@jetspirit.be.

Packaging and insurance

Your purchases are packed with the biggest care, with protection equipment. We take so much care of the packaging that we can propose a delivery in the best conditions. The dispatched products are protected gratis against damaged and theft in transit. So when you receive your order, with the delivery man, you must make sure of your order integrity and of every item in the package so that you can voice a reservation if necessary. If you hesitate about the state or the contents of the order, you must refuse the items at the delivery. Each refused product must be given on his whole to the delivery man and in its own packaging.

In the event of absence

In the event of absence you will find a passing note in your letter box. The first time, a phone number will permit you to arrange a new delivery hour.
If, unfortunately, the second time isn’t the good one yet, you’ll have a time allowed of seven days calendar to take your parcel away at your local post office. After 15 days, the parcel will go back to the depot of Jet Spirit.

Possible lost of a parcel

In spite of the follow-up of the orders on computer, it may exceptionally happen that a parcel gets lost. In that case you must contact our customers’ service by e-mail : info@jetspirit.be.

In case of absolute necessity Jet Spirit is released of his delivery obligation: war, revolt, strike, fire, accident or impossibility to be supplied himself by the suppliers or the normal carriers.

In the following cases, Jet Spirit can temporarily stop the delivery: trouble in the internal network, trouble in telephony, trouble concerning a problematic access to the internet or something like that. Then the contract execution is stopped till the trouble and/or the access to the internet is restored without the buyer could put forward the contract dissolution and/or damage.

Article 7: Order modes

The order is done by the customer to Jet Spirit via the internet site.
The order can be recorded on the site if the user has clearly identify himself. Therefore he must:
  • Log in his customer’s number, this number is strictly personal;
  • Or fill in the order form on line permitting him to have a customer’s number that will be given to him by the “Service Relations Customers” further to his first order.
Each order is equivalent to the prices acceptance and description of the available products on sale (see Article 5: sales conditions). When you order on line, the customer clearly means that he wants to conclude a sale contract with Jet Spirit and that he agrees with the present general conditions.

The customer is informed of this order confirmation by e-mail, this one is called confirmation e-mail, it recaps the order terms. Jet Spirit engages to honor the received orders on the internet site only within the limits of his available products stocks. For lack of the product availability, Jet Spirit engages to inform his customer as quick as possible.

The sale contract between Jet Spirit, on one hand, and the customer, on the other hand, arises of the moment of the order acceptance by Jet Spirit.

For every question concerning the order modes, the customer has just to send an e-mail to info@jetspirit.be.

Article 8: Payment modes.

To treat the orders as soon possible and to offer the best service, Jet spirit invites the customer to pay the purchase price when he orders. When he gives up his order (see Art 10 sale conditions), Jet Spirit is required to refund the amounts paid by the customer, without compensation. The costs of the parcel return are for the customer (see Art 10 sale conditions). The purchase price is paid during the order via the server Ogone-www.ogone.com (see Art 9 sale conditions). Jet Spirit uses Ogone in order that the customer’s bank details should be coded, the transmitted on a safe manner. You can:

  • Indicate what sort of card you have got (Visa, Eurocard, Mastercard), the payment card number, its end date and its visual cipher with explicit command of count debit of the payment card owner.
  • Use Home Banking (Ing Home Pay, Dexia Net Banking and Dexia Direct Net, KBC Online and CBC Online).
  • Use Bancontact/Mastercard for FORTIS, DEXIA, ING and VDK Spaarbank banks customers.
  • Make a transfer or a national, international bank transfer with count PC (computer) or Home Banking (Dexia, ING, CBC/KBC, Fortis, Axa, La Poste, Rabobank, international accounts …)

Permission: the money is saved – blocked on the buyer’s account, before being either transferred on the dealer’s account in a second time (data capture) or released when the permission is called off. NB: the deferred payment and the permission followed by “data capture” are only possible for the payments by credit cards.

Article 9: Security of electronic funds transfer

The procedures of transactions on the merchant site of Jet Spirit take place with the payment service provider highly secured: the company Ogone-www.ogone.com has its headquarters in Brussels.

Ogone is a security expert payments and guarantees that the sensitive data are transmitted and stored according to the standards of safety and of the highest quality.

Working

  • The customer logs on to the internet site of Jet Spirit, selects the items that he puts in his “shopping basket” and he expresses his wish to order.
  • The customer, after having recorded, enters his delivery and invoice data. The total amount of the order including all taxes and shipping costs are listed him.
  • After receiving a summary of his order, the customer confirms his wish to proceed to the step of payment.
  • The customer is redirected transparently to the Ogone site, where he enters his payment settings (payment mode, home banking, credit card number …)
  • The payment is asked at the financial institution concerned.
  • The customer receives the result of the transaction that he can print and keep as proof authentic.
  • Jet Spirit executes the processing after automated sale and sends the package to the customer.

When it’s time to enter the payment settings (step 4), the customer is automatically redirected to the Ogone site. The exchange of sensible data – such as the credit card number – is made between the customer and the Ogone site; Jet Spirit knows nothing about that. Not only the mechanism has the data confidentiality towards Jet Spirit but it allows to incorporate new payment methods without it requests to change the programming of the merchant’s site.

Otherwise all transactions costs (commissions of different financial institutions) are entirely supported by Jet Spirit.
At the end of the payment process (step 7), the hand goes back to the merchant’s site so that he can execute the processing “after sale” of his choice (updated stock, ability to download an intangible property, etc …).

This system offers all the advantages for the payments on the site of Jet Spirit:
  • The confidential data are protected by using the technologies SSL and SET. No information of this type passes in clear over the network.
  • Insure confidentiality of the payment data (especially the credit card number).
  • The merchant or the applications of the merchant’s site don’t know the number of the buyer’s credit card.
  • All communication between the customer’s browser and Ogone e-Commerce is done using encryption techniques SSL 128 bits. It is not possible for the customer to use a browser that wouldn’t support that encryption technique. Ogone e-Commerce has a certificate issued by Verisign.
  • Ogone e-Commerce is protected by different systems of fire wall and protocol conversions to prohibit access to data or to payment processors by unwanted visitors.

Article 10: Right of renunciation

The buyer has the right to notify Jet Spirit that he gives up the purchase without paying a fine and without giving any reason within 14 days from the day of the order delivery.

A reminder of our delivery terms! Your purchases are packed with the utmost care using protective materials. The attention we pay to packaging allows us to propose a delivery in the best conditions.

The sent products are insured gratis against deterioration and theft during the whole transport time. YOU must be sure of the order integrity and of all the items that compose the parcel receipt and in the presence of the person making the delivery to make a reservation if necessary.

Jet Spirit will follow up the renunciation by the buyer only if the original packaging of the product is intact, if the seal and the product itself have especially bee used or damaged.

The buyer’s notification must take place by e-mail (info@jetspirit.be). On that occasion and when the buyer has met the deadline as described in the paragraph above, he will receive a number of return permission. In the case of parcel return and after having warned Jet Spirit by mail in time described above, the return costs of the parcel are paid by the customer. It is also advised to the customer to work with the TAXIPOST services www.taxipost.be for a secure and guaranteed delivery. The customer will be asked to protect with the utmost care depending on the returned items.

To make your life easier when you return your item, Jet Spirit suggests you to pay you back by transfer on your bank account. To benefit this practical service, safe and quick, you must inform your bank account number on the dispatch note that is with the return items.

We will transfer as soon as possible (max 30 days) after Jet Spirit will really know the intent to waive and after the products have been returned to Jet Spirit. The carriage costs are not refunded.

In case of excessive returns, Jet Spirit reserves the right to refuse an order later.

For any question concerning the renunciation terms, the customer must just send a mail to info@jetspirit.be.

Article 11: Guarantees and after sales service

The sold items are guaranteed legal 2 years as the law of 1st September 2004 decrees, law on Consumer Protection in case of sale of consumer goods. In case of exchanged order, the sending costs of the items are paid by the customer. However if the insurance compliance applies to the returned product(s), all the costs related to this return are refunded to the customer.

Whatever problem it is concerning your item, you must absolutely join to the defective appliance a duplicate of the invoice, the warranty of this one (it is in the box) and the return note.

Pay attention! The guarantee is not for the damages repair resulting from a cause external to the appliance (for ex, accident, shock, lightning, current fluctuation, replacement of consumables as batteries, bulbs, fuse wires …) or resulting from the customer’s fault, for example: employment or non-compliant installation to the manufacturer’s specifications, prejudicial use to the good preservation of the appliance, a commercial or collective use, use of belt-lines, accessories or unsuitable consumables… In this respect we invite you to consult carefully the employment notice provided with the products.

In case of products no confirming to the given data during the products presentation on the site or having hidden defects, they will be substituted or refunded according to the availability of similar products and according to the customer’s wish.

The items with a guarantee will only be taken back if they are accompanied by the delivery note. If the item can’t be substituted, lack of stock, you will receive a gift cheque of the value of the purchase price credited to the shop of Jet Spirit.

Are also excluded of the guarantee: the modified products, integrated or added by the customer or by any other person, unauthorized by the supplier. The warranty won’t play for obvious defects. The warranty won’t cover the damaged products during a bad use.

Any return must beforehand be authorized by Jet Spirit with the allocation of a return number. So the customer must apply to Jet Spirit for it: info@jetspirit.be, after written acceptance of Jet Spirit.

Article 12: Responsibility

The company S.A Garage Laeremens, under the trade name Jet Spirit, has only got an obligation of means, for all the access steps to the site, the order process, delivery or later services.

The responsibility of Jet Spirit shouldn’t be engaged for all inconvenient or damages inherent to the use of the internet, especially a break service, an external intrusion or the presence of computer viruses or something of absolute necessity, accordance with the jurisprudence.

Jet Spirit can’t be held responsible, towards a customer or someone else, for any indirect damage, any operating loss, profit, turnover, arising in any manner whatsoever.

Without limiting the preceding paragraphs, the responsibility of Jet Spirit under these terms and conditions can’t exceed an amount equal to the amounts paid or payable during the transaction giving rise to such liability, whatever the cause or the form of the action concerned.

Jet Spirit can’t be responsible for the contract execution concluded in case of stock break or unavailability of the product, of absolute necessity, of perturbation or total or incomplete strike, especially in post services means of transport and/or communication, inundation, fire.

Jet Spirit promises not to disclose to others the given data by the customers on the site. These ones must be confidential. They will be used by the inner services only for your order processing and to consolidate, to personalize the site based on the users’ preferences.

Jet Spirit can provide to others consolidated statistics on his customers, his sales, trade patterns and on data on the site but these statistics won’t have any personal data. So Jet Spirit doesn’t sell, doesn’t commercialize and doesn’t rent to others the data concerning his customers.

Article 13: Copyright

Legal information – use conditions of the site

The use of Jet Spirit site is subject to respect of the general conditions described above. By accessing this site, you declare to be aware and to accept, unreservedly, these general use conditions.

Information and service quality, limit of responsibility

Hyperlinks present on the site portal of Jet Spirit and switching the users to other internet sites don’t engage the responsibility of Jest Spirit regarding the content of these sites. The customer will abide by their use conditions.

Intellectual property rights

The texts, the layouts, the illustrations and other components of the site are protected by copyright or, as far as databases are concerned by a specific right. All these elements are Easyphone SPRL property or, if appropriate, a third one property, where Easyphone has obtained the necessary authorizations.

Unless otherwise specified, the textual or numerical data on the site may be used free of charge but in exchange for the mention of the source and only for a use neither commercial, nor advertising. On the other side, any commercial or advertised information, so that any form of use or reproduction of other elements constitutive of the site, as the graphic line, the pictures, the sounds or the computer applications, are strictly forbidden without prior permission. Any request in that sense must be addressed to the direction of Jet Spirit. (info@jetspirit.be).

Creation of hyperlinks to the site

Jet Spirit authorizes the creation of surface linking without prior request, the surface linking send back to the home page of the site portal or to any other page as a whole. On the other side, the use of all techniques to include all or part of the site portal in an internet site by masking partially the exact origin of the information or by confusing on the origin of the information, as framing or in-lining, requires the written permission of Jet Spirit. Any request in that sense must be addressed to the direction of Jet Spirit (info@jetspirit.be).

Transmitted information

Don’t pass illegal, menacing, defamatory, obscene, scandalous, challenging, pornographic or blasphemous information, or any other information causing a civil or penal responsibility, according to the law of the land to which the site refers.

Article 14: Entirety

If one of the clauses of this present contract should be null and void by a change of legislation, in regulation or by a court decision, it can’t, on no account, affect the validity and the respect of the present general sales conditions.

Article 15: Duration

The present conditions apply for the duration of on-line of the services offered by Jet Spirit.

Article 16: Proof

The computerized records, preserved in the computer systems of the company Jet Spirit and of his partners in reasonable security conditions, will be considered as communications proofs, orders proofs, payments proofs, interfered between the parties.

The items sold by Jet Spirit are in accordance with the description and the given presentation in the catalog. In spite of all our precautions, errors may exist in this catalog. On no account we couldn’t be engaged in this fact.

Article 17: Preservation and archiving of the transactions

The archiving of the orders forms and the invoices is done on a reliable and durable support, so that it can correspond to a faithful and durable copy.

Article 18: Relevant law and competence

The present conditions are subject to the Belgian law. In case of dispute the customer will apply to Jet Spirit in priority to obtain an amicable solution. For lack of an amicable solution, only the courts of the judicial districts of Liège are qualified, whatever the delivery places and the accepted payment modes.

Article 19: Customs duty

Any order done on the site and delivered outside the countries of the European Union can be subject to possible taxes and by customs duty which are fixed when the parcel arrives at destination. This customs duty and possible taxes, bound to an item delivery, are paid by the customer and is of his responsibility. Jet Spirit is not required to check and to inform his customers about the customers ‘duty and applicable taxes.

To know them, the customer must ask the competent authorities of his country.

Article 20: Stock – availability of the products, clothes, accessories, creators and services

On each form of the product description there is the stock state. The stock is carefully followed by Jet Spirit in real time.

In the event of a total or partial unavailability of pieces after ordering, the customer will be informed by e-mail about the delivery of a partial order or about the cancellation of his order. In case of unavailability of the product or of the service, the customer can:
  • Receive a quality piece of the same price within the limits of available stocks;
  • Be refunded of the price of the ordered item within 30 days after order;
  • Receive an item of the same price.

Article 21: Compliance clothing; products or accessories

The information listed on each “description/detail” are the ones communicated to Jet Spirit by BRP and by other suppliers from whom pieces are required; Jet Spirit will do his best so that the presented photographs on the internet site are as true as possible to the pieces themselves.

However, seeing that the photographs can be seen on the internet, it is possible that the perception by the customer of the photographic presentation of the items isn’t exactly the same as the piece itself, as, for example, the colour.

In final, the photography of the pieces for sale won’t be identical to the piece finally bought but almost identical.In case of non-compliance of the piece delivered to the customer, the customer will be allowed to send it back to Jet Spirit by following the procedure below but the customer must accept to support the proof of the non-compliance of a piece. The customer can ask Jet Spirit :
  • To be delivered of an identical piece to the ordered piece, within the limits of the available stock;
  • To be delivered of a quality piece and of the same price, within the limits of the available stocks;
